{"id":484,"date":"2026-06-09T20:00:02","date_gmt":"2026-06-09T20:00:02","guid":{"rendered":"https:\/\/consumerconnectng.com\/?p=484"},"modified":"2026-06-10T01:44:19","modified_gmt":"2026-06-10T01:44:19","slug":"cbn-tracks-forex-reforms-with-n100m-penalty-for-erring-banks","status":"publish","type":"post","link":"https:\/\/consumerconnectng.com\/?p=484","title":{"rendered":"CBN tracks Forex reforms with N100m penalty for erring banks"},"content":{"rendered":"<p>*<strong><em>The new Central Bank of Nigeria&#8217;s sanction reportedly forms the backbone of a broader regulatory framework designed by the Trade and Exchange Department of CBN, to tighten oversight, eliminate market abuses, and ensure that Foreign Exchange is channelled exclusively into productive sectors of the economy<\/em><\/strong><\/p>\n<p>Isola Moses | ConsumerConnect<\/p>\n<p>The Central Bank of Nigeria (CBN) has announced a far-reaching compliance regime by introducing a N100 million penalty for any Deposit Money Banks (DMBs) that process Foreign Exchange transactions (Forex) for customers without adequate documentation.<\/p>\n<p><em>ConsumerConnect<\/em> reports the CBN noted this in its newly released Fourth Edition of the Foreign Exchange Manual.<\/p>\n<blockquote class=\"wp-embedded-content\" data-secret=\"eAtCPwaW82\"><p><a href=\"https:\/\/consumerconnectng.com\/?p=527\">OAU: Minister inaugurates hi-tech hub, inspires students to turn ideas into solutions<\/a><\/p><\/blockquote>\n<p><iframe loading=\"lazy\" class=\"wp-embedded-content\" sandbox=\"allow-scripts\" security=\"restricted\" style=\"position: absolute; visibility: hidden;\" title=\"\u201cOAU: Minister inaugurates hi-tech hub, inspires students to turn ideas into solutions\u201d \u2014 ConsumerConnect \" src=\"https:\/\/consumerconnectng.com\/?p=527&amp;embed=true#?secret=tyZE9PiCOW#?secret=eAtCPwaW82\" data-secret=\"eAtCPwaW82\" width=\"600\" height=\"338\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\"><\/iframe><\/p>\n<p>The Bankers\u2019 Bank particularly specified that authorised Forex dealers caught violating these rules must pay the N100 million flat fee besides extra N10 million for every single deficient transaction in the market.<\/p>\n<p>It is noted that the new CBN sanction forms the backbone of a broader regulatory framework designed by Trade and Exchange Department of CBN, to tighten oversight, eliminate market abuses, and ensure that foreign exchange is channelled exclusively into productive sectors of the economy.<\/p>\n<p>Marking the first major overhaul of the manual since 2017, the May 2026 update acts as the definitive regulatory playbook for banks, exporters, investors, and the general public.<\/p>\n<p>Aside from the headline documentation fines, CBN is targeting banks that breach their approved Net Open Position limits with a progressive punishment scale.<\/p>\n<p>The Bank stated that a first-time violation earns a warning letter, but a second offence triggers a 10-working-day market suspension, which escalates to a 90-day ban for a third strike.<\/p>\n<p>Reporting timelines have also been aggressively squeezed, requiring banks to submit daily transaction returns by 10 a.m. the following day and monthly returns within five working days of month-end.<\/p>\n<p>However, late submissions will cost lenders N500,000, while failing to submit them at all carries a minimum N5 million fine alongside a daily penalty of N500,000 until rectified, CBN noted.<\/p>\n<p>Unauthorised reallocation of Forex funds is met with equal severity, threatening banks with monetary penalties, a minimum six-month licence suspension, or outright revocation.<\/p>\n<p>Import and export operations are facing a parallel squeeze. Importers are now legally bound to submit Exchange Control Documents within 90 days of negotiating shipping papers with overseas correspondent banks.<\/p>\n<p>Failure to do so will lock them out of all valid and non-valid forex transactions, including Form M processing, via a staggered ban that scales from 90 days for a first offence up to a permanent market ban by the fourth violation.<\/p>\n<p>Banks that turn a blind eye to these importer defaults face a warning and a N10 million fine per transaction.<\/p>\n<p>For exporters, the clock is ticking faster; non-oil export proceeds must hit domiciliary accounts within 180 days of shipment, while oil and gas proceeds must be repatriated within 90 days.<\/p>\n<p>Exporters missing these windows face a penalty worth one percent of the naira value of the outstanding funds, while the banks failing to enforce this compliance will be docked 0.5 percent of the total value.<\/p>\n<p>Despite the heavy-handed penalties, the revised manual introduces several operational cushions designed to lubricate the wheels of legitimate trade and improve market efficiency.<\/p>\n<p>CBN has doubled the allowable advance payment for imports from 15 percent to 30 percent and introduced a ten percent permissible import margin on Form M values, while entirely scrapping processing fees for export Form NXPs.<\/p>\n<p>Modernised provisions have also been added to cover service exports, technology remittances, and regional transactions via the Pan-African Payment and Settlement System.<\/p>\n<p>For regular citizens, the framework accommodates tuition remittances up to $25,000 per semester for overseas studies and removes the mandatory Form A requirement for remittances funded through ordinary domiciliary accounts, though banks must still verify the legitimacy of the transfers.<\/p>\n<p>According to the Management of the CBN, the latest extensive Forex reforms are the product of wide-ranging consultations with corporate stakeholders, regulators, and development partners.<\/p>\n<p>Olayemi Cardoso, Governor of CBN, in the new Forex regulatory framework, noted that the overhaul was vital to adapt to evolving global economic shifts and domestic structural realities, reflecting a deep commitment to modernising Nigeria&#8217;s macroeconomic stability.<\/p>\n<p>Echoing this sentiment, Muhammad Abdullahi, Deputy Governor of Corporate Services,&nbsp; emphasised that the ultimate goal of these changes under Cardoso\u2019s leadership is to strip away transaction friction, restore international confidence, and build a highly transparent, rules-based foreign exchange market that seamlessly serves legitimate users.<\/p>\n<p><strong>What has changed in <\/strong><strong>regulator\u2019s Forex<\/strong><strong> rulebook?<\/strong><\/p>\n<p>Industry analysts and observers reportedly hinted that the CBN new Foreign Exchange rulebook marks its toughest compliance crackdown in years.<\/p>\n<p>The framework is coming after repeated concerns over Forex round-tripping, weak documentation, delayed export repatriation, and opaque market practices that have contributed to Naira volatility and reduced investor confidence.<\/p>\n<p>By imposing fines as high as N100 million on banks for documentation failures, tightening reporting deadlines, and introducing escalating sanctions for importers, exporters, and lenders, the apex bank is signalling a shift toward stricter enforcement rather than policy relaxation.<\/p>\n<p>While the reforms offer some relief for legitimate trade through higher import advance payments, easier education remittances, and lower export processing costs, their success will ultimately depend on whether stronger compliance translates into improved forex liquidity, greater transparency, and a more stable exchange rate without creating excessive bureaucracy for genuine
